Terms and Conditions

These Terms and Conditions (hereinafter: “Terms”) govern the booking and provision of tourism services by Zico turizam d.o.o. (hereinafter: “Zico Tours”, “we”, “us”, “our”) and the relationship between Zico Tours and the customer (hereinafter: “Customer”, “Traveler”, “you”, “your”). By booking a tour or service with Zico Tours, you confirm that you have read, understood, and agreed to these Terms.

Zico Tours is a licensed Croatian travel agency and tour operator authorized to organize and sell tourism services in accordance with the Croatian Act on the Provision of Tourism Services.

2. Tour Categories

Zico Tours offers the following categories of services, each subject to slightly different conditions where indicated:

  • Private day trips and city tours – tailor-made or pre-designed single-day tours operated exclusively for your party.
  • Multi-day travel packages – pre-designed itineraries spanning multiple days, with fixed routings and inclusions.
  • Tailor-made tours – fully customized multi-day itineraries created on your request.
  • Study tours – thematic tours designed for academic, professional, or special-interest groups.
  • Group tours – tours operated with multiple participants from different bookings, with a fixed itinerary and departure date.

3. Booking Process

3.1 How to Book

Bookings can be made through the following channels:

  • Our website at zicotours.com using the Bokun booking widget
  • Email at info@zicotours.com
  • Phone at +385 99 518 3477
  • Through authorized third-party platforms (e.g. Viator, GetYourGuide, TripAdvisor)

3.2 Booking Confirmation

A booking becomes binding once:

  1. You have submitted the booking request with all required details;
  2. You have paid the deposit (or full amount, depending on the timing — see Section 4); and
  3. We have sent you a written booking confirmation (typically by email).

The booking confirmation, together with these Terms, constitutes the contract between you and Zico Tours.

3.3 Information You Must Provide

When making a booking, you must provide:

  • Full names of all travelers (as they appear on travel documents)
  • Date of birth for each traveler
  • Nationality and passport/ID details (where required)
  • Valid email address and phone number
  • Any special requirements (dietary, accessibility, medical conditions relevant to the trip)

You are responsible for ensuring that all information provided is accurate. We are not liable for any consequences resulting from incorrect or incomplete information (e.g. denied boarding due to passport mismatch).

4. Payment Terms

4.1 Currency and Payment Methods

All prices are quoted in Euro (EUR). We accept the following payment methods:

  • Credit card (Visa, Mastercard, American Express) via Stripe through the Bokun booking system
  • Bank transfer (SEPA for EU, SWIFT for international)
  • Other payment methods as agreed in writing

4.2 Deposit and Final Payment

If the final payment is not received by the due date, we reserve the right to cancel the booking and apply the cancellation fees set out in Section 5.

4.3 Payment Security

All card payments are processed through Stripe via the Bokun booking system. Stripe is PCI-DSS Level 1 compliant. Zico Tours does not store full credit card numbers on its servers.

4.4 Price Changes

Prices are guaranteed once your booking is confirmed and the deposit is paid, except in the following circumstances:

  • Significant changes in transport costs (e.g. fuel surcharges)
  • Changes in taxes, fees, or exchange rates that materially affect the tour cost
  • Changes requested by you to the itinerary or services

In the rare event that a price increase exceeds 8% of the total tour price, you have the right to cancel the booking with a full refund of amounts paid.

5. Cancellation by the Customer

5.1 Cancellation Fees

All cancellations must be made in writing (email is sufficient) to info@zicotours.com. The cancellation date is the date we receive your written notice.

5.2 Day Tours and Short Tours

For day tours and short tours (1-2 days), the following cancellation policy applies:

  • More than 48 hours before tour start: full refund
  • 48 to 24 hours before tour start: 50% cancellation fee
  • Less than 24 hours before tour start, including no-show: 100% cancellation fee

5.3 Tailor-made Tours

For fully customized tailor-made tours, cancellation fees may be higher than those set out above due to non-refundable costs already incurred on your behalf (e.g. private accommodation bookings, private guides, specialty experiences). Specific cancellation terms will be communicated to you at the time of booking.

5.4 Recommendation

We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical expenses, and personal liability. See Section 9 for details.

6. Cancellation or Changes by Zico Tours

6.1 Reasons for Cancellation

We reserve the right to cancel a tour in the following circumstances:

  • Insufficient number of participants for group tours (minimum participation requirements will be communicated at booking)
  • Force majeure events (see Section 11)
  • Failure of the Customer to make timely payment (see Section 4.2)

6.2 Refunds Following Cancellation by Zico Tours

If we cancel a tour for reasons other than your non-payment or force majeure, you are entitled to:

  • A full refund of all amounts paid; or
  • An alternative tour of equivalent or higher value (with any price difference refunded or charged); or
  • A travel voucher for the full value, valid for 24 months.

6.3 Itinerary Changes

We reserve the right to make minor changes to the itinerary due to operational, weather, safety, or local conditions. We will inform you of any changes as soon as possible. For significant changes (e.g. change of accommodation category, major route change), you have the right to:

  • Accept the proposed change;
  • Choose an equivalent alternative; or
  • Cancel the booking with a full refund of amounts paid.

7. What Is Included and Excluded

The exact inclusions and exclusions vary by tour and will be specified in your booking confirmation. As a general guide:

7.1 Typically Included

  • Transport as specified in the itinerary
  • Accommodation as specified in the itinerary
  • Specified meals (typically breakfast; lunches and dinners as noted)
  • English-speaking professional guide for guided portions
  • Entrance fees to attractions explicitly listed
  • Local taxes and tourist fees
  • 7.2 Typically Excluded

    • International flights to/from Croatia (unless explicitly stated)
    • Travel insurance (see Section 9)
    • Visa fees, where applicable
    • Personal expenses (drinks, souvenirs, laundry, etc.)
    • Tips for guides and drivers (recommended but not mandatory)
    • Meals not explicitly included in the itinerary
    • Optional activities and excursions

    8. Traveler Obligations

    As a traveler with Zico Tours, you agree to:

    • Hold valid travel documents (passport or ID card) and any required visas for the duration of the trip;
    • Comply with health requirements applicable to destinations on the itinerary (vaccinations, health declarations);
    • Follow reasonable instructions from guides and tour leaders regarding safety, schedules, and conduct;
    • Respect local laws, customs, and the environment in countries visited;
    • Treat fellow travelers, guides, drivers, and service providers with respect;
    • Arrive on time at scheduled meeting points and departures;
    • Inform us promptly of any complaints or issues that arise during the tour, so we can attempt to resolve them on the spot.

    Zico Tours reserves the right to terminate the tour for any traveler whose behavior endangers themselves, other travelers, or third parties, or causes significant disruption. In such cases, no refund will be provided.

    9. Travel Insurance

    Travel insurance is not included in the tour price unless explicitly stated. We strongly recommend that you obtain comprehensive travel insurance before your tour, covering:

    • Trip cancellation and interruption
    • Medical expenses and emergency evacuation
    • Personal accident and liability
    • Loss of luggage and personal belongings

    On request, we can offer insurance through our partner Allianz. Specific policies and pricing are available at the time of booking. By accepting our insurance offer, you also accept the relevant policy terms and conditions of the insurance provider.

    You are responsible for ensuring that your insurance is valid for all destinations on your itinerary and for all activities you plan to participate in (e.g. some adventure activities may require special coverage).

    10. Health, Safety, and Special Requirements

    10.1 Health and Fitness

    Some of our tours involve walking, climbing stairs, uneven terrain, or other physical activity. By booking, you confirm that you are in suitable physical condition to participate. If you have specific health conditions or mobility limitations, please inform us at the time of booking so we can advise on tour suitability and any necessary accommodations.

    10.2 Pregnancy

    Pregnant travelers should consult their doctor before booking and inform us in writing. Some activities may not be suitable during pregnancy.

    10.3 Minors

    Travelers under the age of 18 must be accompanied by a parent or legal guardian who assumes full responsibility for them. Bookings on behalf of minors must be made by a parent or guardian.

    10.4 Dietary Requirements

    We can accommodate most dietary requirements with advance notice. Please inform us of any allergies or dietary restrictions at the time of booking. We cannot guarantee allergen-free environments at all venues.

    11. Force Majeure

    Neither party shall be liable for failure to perform obligations under these Terms due to circumstances beyond reasonable control, including but not limited to:

    • Natural disasters (earthquakes, floods, storms, volcanic activity)
    • War, civil unrest, terrorism, or threats thereof
    • Strikes, labor disputes, or industrial action
    • Pandemics, epidemics, or public health emergencies, including government-imposed travel restrictions
    • Border closures or significant transport disruptions
    • Government actions or regulations preventing travel

    In case of force majeure affecting the tour, we will work with you in good faith to find a solution (rescheduling, alternative itinerary, or partial refund of recoverable costs). Non-recoverable costs already paid to third-party providers (hotels, transport, etc.) may not be refundable.

    12. Complaints and Dispute Resolution

    12.1 On-the-Spot Resolution

    If you have a complaint during the tour, please inform your guide or contact us immediately at +385 99 518 3477 so we can attempt to resolve the issue on the spot. Many issues can be resolved quickly if reported promptly.

    12.2 Written Complaints

    If your complaint cannot be resolved on the spot, please submit it in writing to info@zicotours.com within 8 days of the end of your tour, providing:

    • Your booking reference
    • Detailed description of the issue
    • Any supporting evidence (photos, receipts)
    • Your proposed resolution

    We will acknowledge your complaint within 8 days and provide a substantive response within 15 days of receipt.

    12.3 Alternative Dispute Resolution

    If we cannot resolve your complaint to your satisfaction, you may submit a complaint to:

    • Croatian Chamber of Economy (Hrvatska gospodarska komora) for tourism-related disputes
    • EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr (available to EU consumers)

    12.4 Court Jurisdiction

    If the dispute cannot be resolved through the above channels, the courts of Zagreb, Croatia, shall have exclusive jurisdiction. Croatian law shall apply to these Terms and any related disputes.

    13. Liability

    13.1 Our Liability

    Zico Tours acts as an organizer of tourism services and is liable for the proper performance of the services included in your booking, in accordance with the Croatian Act on the Provision of Tourism Services and EU Package Travel Directive.

    13.2 Limitations of Liability

    Our liability is limited as follows:

    • For non-bodily injury claims, our liability is limited to three times the total tour price.
    • We are not liable for losses caused by force majeure (see Section 11) or by your own actions or those of third parties unrelated to the tour.
    • We are not liable for goods or services purchased independently outside the tour program.

    13.3 Insurance Coverage

    Zico Tours holds professional liability insurance and insolvency protection insurance in accordance with Croatian law, providing additional protection for our customers.

    14. Privacy and Data Protection

    We process your personal data in accordance with the General Data Protection Regulation (GDPR) and Croatian data protection law. For full details on how we collect, use, and protect your personal data, please read our Privacy Statement and Cookie Policy.

    15. Photography and Media

    Photographs and video may be taken during tours for promotional purposes (website, social media, marketing materials). By participating in a tour, you consent to such use. If you do not wish to be photographed or filmed, please inform your guide at the start of the tour.

    16. Intellectual Property

    The text, itineraries, design, layout, and logos on the zicotours.com website are the property of Zico turizam d.o.o. and are protected by copyright and other intellectual property rights.

    Photographs and images used on the website are either owned by Zico turizam d.o.o., licensed from third parties (including stock photography providers and partners), or used with permission from their respective owners. All rights remain with the respective rights holders.

    You may not reproduce, distribute, modify, or commercially use any content from this website without prior written permission. For non-commercial personal use, you may share links to our pages and content via social media.

    If you believe that any content on our website infringes your intellectual property rights, please contact us at info@zicotours.com so we can investigate and take appropriate action.

    17. Modifications to These Terms

    We may update these Terms from time to time. The version of the Terms applicable to your booking is the version in effect at the time of your booking confirmation. We will publish updated Terms on our website with a new “Last updated” date.

    18. Severability and Governing Law

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms are governed by the laws of the Republic of Croatia and the European Union, in particular the Croatian Act on the Provision of Tourism Services and the EU Package Travel Directive (Directive 2015/2302).
